1. Agreement to Terms

These Terms & Conditions (“Terms”) form a legally binding agreement between you and Bself Ltd, trading as XavSafety. They govern your access to and use of the XavSafety website, services, digital products, live training, memberships, and all related content.

By using any XavSafety service or product, you accept these Terms in full. If you do not agree, you must not use the services.

2. Changes to Terms

We may revise these Terms at any time without notice. The version active at the time of your access or purchase is the one that governs your use. It is your responsibility to check for updates.

3. Who We Are

XavSafety is an educational safety training platform offering situational awareness training, personal safety protocols, behavioral analysis tools, and related services under the registered company Bself Ltd.

4. Intellectual Property Rights

All content, branding, training structures, acronyms, course materials, and future developments created by XavSafety are the exclusive intellectual property of Bself Ltd and are protected under international copyright, trademark, design, and trade secret law.

This includes but is not limited to:

• Training program names (e.g. Act Before You React, See What Others Miss)

• Visual materials, slide decks, documents, videos, lesson plans

• Website design, user flows, platform layout

• Proprietary frameworks, acronyms, internal tier systems (whether or not currently public)

• Any future evolutions of the above

You may not:

• Copy, share, resell, reverse-engineer, or adapt any XavSafety material without express written permission

• Use XavSafety branding, concepts, or frameworks to create competing services or derivative content

• Grant access to our protected content to third parties

Violation may result in suspension, legal action, and financial penalties.

5. Services and Access

Your access to our services (free or paid) is granted on a license basis. We retain all rights to suspend, revoke, or modify access at any time.

Do not share your login credentials, content, or private links. Doing so constitutes a breach of these Terms.

6. Your Responsibilities

You agree to:

• Use the services legally and respectfully

• Not infringe on our IP or disrupt other users

• Not use XavSafety content in commercial settings unless formally licensed

We reserve the right to immediately terminate access if you breach any part of these Terms.

7. Purchases, Subscriptions & Payments

Prices are listed in GBP (£) and include VAT where applicable. Payments are processed securely via third-party gateways.

Access is granted only after full payment is received.

Discount codes or promotional offers must be applied at checkout and cannot be applied retroactively.

8. Refund Policy

Digital Products

Due to the nature of digital goods, we do not offer refunds except in rare, justified cases. Downloading digital content voids eligibility for a refund.

Memberships

You may cancel your membership at any time. No partial refunds are provided. Access will remain until the end of the billing cycle.

​

Events or Live Training

Cancellations made 7+ days before the event are refundable. Within 7 days, refunds are at our discretion.

9. Fulfilment & Delivery

Physical products are shipped through third-party couriers. We are not liable for delivery delays or losses caused by external factors.

Digital products are delivered via email or instant download. If you do not receive your product, contact support within 48 hours.

10. Third-Party Platforms

We use third-party platforms (e.g. Wix, Kajabi, YouTube, Stripe) to deliver parts of our services. We are not liable for outages, performance issues, or privacy concerns related to those platforms.

You agree to be bound by their terms as well.

11. Privacy

We collect and store personal information only as necessary to provide our services, process payments, and communicate with you. Use of our services constitutes consent to our Privacy Policy.

12. Limitation of Liability

Our training improves situational awareness but cannot guarantee safety. You are responsible for your own decisions and actions.

To the fullest extent permitted by law, Bself Ltd is not liable for:

• Physical injury, emotional harm, or property damage

• Loss of data, revenue, or business

• Disruption caused by third-party services or technical issues

13. Termination

We may suspend or permanently terminate your access without notice if you:

• Breach these Terms

• Misuse our platform or content

• Engage in harmful, illegal, or disruptive conduct

No refunds will be provided in such cases.

14. Governing Law & Disputes

These Terms are governed by the laws of England and Wales.
Any disputes must first be raised in writing with support@xavsafety.com.
If unresolved, they will be referred to the courts of England and Wales.

15. Legal Agreement at Checkout or Registration

Before purchasing or registering, you must check a box confirming:

This digital agreement is enforceable as a contract. Without acceptance, access is denied.
